HMRC reforms to the intermediaries’ legislations (IR35) for public sector bodies have come into force 6 April 2017 onwards.

As a result, recruitment agencies supplying staff to the public sector are responsible for determining the taxation status of PSC contractors upon information from the end public sector client as to whether they are legitimately self-employed or disguised employees, and then deduct and pay the employment taxes correctly.


As a consequence, recruitment agencies are obliged to undertake several tasks:

Invest in more payroll staff, establish an employment team with compliance expertise
Pay and bill payroll for contractors falling outside the scope of IR35, followed by quarterly intermediaries reporting to HMRC
Undertake technology upgrades and bring in compliance expertise on HMRC employment tax laws
